End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity, "User" or "you") and Horizon Tech Development, LLC ("Licensor," "we," "us," or "our") for the software applications published by Horizon Tech Development, LLC, including but not limited to WorkSite Pro (Horizon Workbench), Brass & Powder, and RiderRadar (collectively, the "Software" or "Apps").

By installing, copying, or otherwise using any of our Apps, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.

1. Grant of License

Horizon Tech Development, LLC grants you a limited, non-exclusive, non-transferable license to install and use the Software on your personal devices, subject to the following conditions:

For Free Apps

  • You may install and use the Software on any number of personal devices you own or control.
  • You may not redistribute, sell, or rent copies of the Software.

For Subscription Apps

  • Your license is valid only while your subscription is active.
  • The number of devices or users may be limited based on your subscription tier.
  • Additional terms may apply as specified in the app store listing or within the app.

2. Scope of License

You are granted the right to:

  • Use the Software for its intended purpose
  • Make a reasonable number of backup copies for archival purposes
  • Transfer the Software to another device you own (subscription permitting)

You may NOT:

  • Copy, modify, or distribute the Software except as expressly permitted
  • Reverse engineer, decompile, or disassemble the Software (except and only to the extent that such activity is expressly permitted by applicable law)
  • Rent, lease, or lend the Software to third parties
  • Use the Software for any illegal purpose
  • Remove, alter, or obscure any proprietary notices on the Software
  • Use the Software to create a competing product or service
  • Use the Software in any manner that violates applicable laws or regulations

3. Intellectual Property

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.

All title and intellectual property rights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software) are owned by Horizon Tech Development, LLC or its suppliers.

You acknowledge that no title to the intellectual property in the Software is transferred to you. You acquire only the right to use the Software and do not acquire any rights of ownership.

4. User Data

You own all data you create, input, or generate using the Software. Horizon Tech Development, LLC does not claim any ownership rights over your data.

5. Updates and Upgrades

We may, from time to time, provide updates, upgrades, or patches to the Software ("Updates"). Such Updates may be provided automatically through app store mechanisms or within the app itself.

Updates may be required to continue using the Software. We are not obligated to provide any Updates. If we provide Updates, they are subject to this EULA unless accompanied by a separate license.

We may discontinue support for older versions of the Software. We will provide reasonable notice before discontinuing support for a major version.

6. Third-Party Components

The Software may include third-party components (open source libraries, frameworks, or other software) that are subject to their own license terms. Such third-party licenses are incorporated by reference into this EULA.

A list of third-party components and their licenses is available within the Software's settings or upon request.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

8. Limitation of Liability

IN NO EVENT SHALL HORIZON TECH DEVELOPMENT, LLC OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF HORIZON TECH DEVELOPMENT, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. FOR FREE SOFTWARE, OUR LIABILITY SHALL BE LIMITED TO US$1.00.

9. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this EULA.

Upon termination of this license, you must stop using the Software except to the extent necessary to export or recover your data where the Software provides that capability.

For subscription-based Software, cancellation or expiration may end access to paid features at the end of the applicable paid or grace period. Cancellation does not automatically delete your account or data; account deletion is handled separately under the applicable Privacy Policy and in-app account controls.

10. Governing Law

This EULA is governed by the laws of the State of Missouri and applicable United States federal law, without regard to conflict-of-law rules. Nothing in this EULA limits rights or remedies that cannot lawfully be waived under applicable consumer law.

11. Export Restrictions

You agree to comply with all applicable export and import laws and regulations. You will not export or re-export the Software in violation of any applicable laws or regulations, or without all required licenses and authorizations.

12. U.S. Government Restricted Rights

If the Software is acquired by or on behalf of a unit or agency of the United States Government, the Software is commercial computer software and the documentation is commercial computer software documentation. Use, duplication, or disclosure is subject to the restrictions set forth in this EULA.

13. Indemnification

You agree to indemnify, defend, and hold harmless Horizon Tech Development, LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Software
  • Your violation of this EULA
  • Your violation of any rights of another party
  • Your User Content

14. Severability

If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

This EULA, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between you and Horizon Tech Development, LLC relating to the Software and supersedes all prior or contemporaneous oral or written agreements.

App-Specific Terms

The following additional or modified terms apply to specific applications:

RiderRadar

Additional Restrictions

In addition to the general restrictions above, you agree not to:

  • Use RiderRadar to harass, abuse, threaten, or harm others
  • Share another user's location without their explicit consent
  • Use automated systems (bots, scrapers) to access the App

Location Data

RiderRadar requires location permissions to function. Key provisions:

  • Location is shared only with authorized friends, groups, or RiderBeacon public map pins if enabled
  • You can enable Ghost Mode to hide your location
  • You can enable Location Scrambling for approximate location sharing
  • You can disable location sharing at any time in Settings

User Content

You retain ownership of all messages, images, and other content you create or upload ("User Content"). You grant us a limited license to store, transmit, display, and process your User Content solely to provide and improve the Services.

Account Requirements

  • You must be at least 13 years old to use RiderRadar
  • Users under 18 require parental consent
  • You are responsible for maintaining account security

Subscriptions and Paid Features

RiderRadar may offer paid digital features, including Business Pro subscriptions for eligible business accounts:

  • Mobile digital subscriptions are processed by Apple App Store or Google Play using their in-app purchase systems.
  • The purchase screen will disclose the subscription name, duration, renewal price, billing frequency, and included features.
  • Subscriptions auto-renew unless cancelled through the applicable store account before renewal.
  • Restoration, cancellation, billing grace periods, refunds, and price-change consent are governed by the applicable platform rules and applicable law.
  • Stripe may be used separately for event-ticket commerce; it is not the billing path for RiderRadar Business Pro mobile subscriptions.

Specific Liability Exclusions

We are not liable for:

  • Accidents, injuries, or damages arising from use of the App
  • Motorcycle accidents or incidents during rides
  • Actions of other users
  • Third-party services (maps, hosting, etc.)

Brass & Powder

Offline Functionality

Brass & Powder is designed to work entirely offline. All data is stored locally on your device. You are responsible for:

  • Backing up your data regularly
  • Exporting data before device changes or resets
  • Securing your device and any exported data

Data Responsibility

Since all data is stored locally:

  • We cannot recover lost data
  • Data loss may occur if you uninstall the app without exporting
  • You are responsible for safe handling of your reloading data

Safety Disclaimer

Brass & Powder is a tracking tool only. It does not provide reloading advice or load recommendations. Always:

  • Consult reputable reloading manuals and resources
  • Verify all loads before use
  • Follow all firearm and reloading safety guidelines
  • Understand that reloading involves inherent risks

WorkSite Pro

Business Use

WorkSite Pro is designed for field service business operations. By using WorkSite Pro, you acknowledge:

  • You are responsible for the accuracy of your business data
  • You are responsible for compliance with local business regulations
  • Invoices and estimates generated are your responsibility

Data Management

WorkSite Pro uses a connected hosted service and may also retain local/offline-capable app data on your device. You are responsible for:

  • Regular data backups
  • Securing access to your device and any cloud accounts
  • Protecting client and business information

Push Notifications

WorkSite Pro uses Expo Application Services (EAS) to deliver push notifications. By using push notification features, you agree that:

  • Push tokens are collected to deliver notifications to your device
  • Notification content is transmitted through EAS infrastructure
  • You can disable notifications in your device settings or within the app
  • EAS's Terms of Service and Privacy Policy apply to push notification delivery

Diagnostics

WorkSite Pro does not currently use Firebase Analytics. Limited operational diagnostics and allow-listed metadata may be processed when needed to secure, troubleshoot, or support the connected service, or when a user explicitly submits feedback.

Third-Party Services

WorkSite Pro relies on hosted API/database infrastructure, Expo services for mobile distribution and push notifications, transactional email delivery, and the Horizon Feedback API. Optional payment or SMS integrations may be enabled in future releases and will be disclosed when active.

Founders Early Access

WorkSite Pro / Horizon Workbench may offer a paid Founders early-access tier while the product is still in beta. Founders subscriptions are recurring digital subscriptions unless the applicable offer expressly states otherwise.

  • The store purchase screen controls the actual price, billing period, renewal terms, and cancellation method.
  • Founders access may include evolving beta features that can change as the product is refined.
  • Complimentary lifetime founder access granted to selected testers is a separate non-purchase entitlement and does not represent a store transaction.
  • Mobile paid Founders access is intended to use Apple App Store or Google Play billing and server-side entitlement verification.
  • If the offer promises continued Founders pricing while continuously subscribed, any later change remains subject to store rules and applicable law.

No Professional Advice

WorkSite Pro is a productivity tool. It does not provide:

  • Legal, accounting, or tax advice
  • Business management recommendations
  • Professional contracting guidance

This End User License Agreement applies to all Horizon Tech Development, LLC applications. By using any of our Apps, you acknowledge that you have read, understood, and agree to be bound by this EULA.
